Terms of Service

These Terms of Service (the "Terms") govern your use of the Remittix Markets trading interface at remittix.io (the "Interface"), operated by Remittix Limited ("Remittix", "we", "us").

By accessing or using the Interface, you agree to these Terms. If you do not agree, do not use the Interface. These Terms include a limitation of liability and a waiver of class actions. Please read them.

1. What Remittix Markets Is

Remittix Markets is a front-end interface. It lets you send instructions to the Hyperliquid protocol (the "Protocol"), a decentralised third-party system that we do not own, operate or control.

We do not execute your trades, match orders, hold margin or settle positions. The Protocol does all of that automatically. We are not your broker, dealer, exchange, market maker or counterparty, and we do not act as your agent.

Once a transaction is submitted, it is irreversible. We cannot cancel, reverse, modify or recover it.

We are not responsible for the Protocol — including its security, pricing, liquidation logic, funding rates, downtime or continued availability. You can access the Protocol through other interfaces or directly; using ours is entirely your choice.

2. Who May Use the Interface

By using the Interface, you confirm that you are at least 18 years old and legally able to enter into these Terms.

You may not use the Interface if you are a citizen, resident or located in, or an entity organised in, any of the following: the United States of America and its territories; the Province of Ontario, Canada; the United Kingdom (unless you are a professional client or eligible counterparty); Cuba; Iran; North Korea; Syria; the Russian Federation; Belarus; the temporarily occupied territories of Ukraine, including Crimea and the occupied parts of the Donetsk, Luhansk, Zaporizhzhia and Kherson regions; or any other place where use of the Interface would be unlawful.

You also may not use the Interface if you are subject to sanctions imposed by the United States (including OFAC), the United Nations, the European Union or the United Kingdom, or are owned or controlled by a sanctioned person.

You must not use a VPN, proxy or any other method to hide your location or get around these restrictions. We may use IP-based geo-blocking, wallet screening and other measures, and we may block access to anyone at any time.

3. Your Wallet and Your Assets

You keep full control of your wallet, your private keys and your assets at all times. We never hold your assets and never have access to your keys.

The "Deposit" and "Withdraw" functions move assets between your wallet and the Protocol. They are not transfers to us and do not create an account, deposit or custody relationship with us.

If you lose your private keys or seed phrase, your assets are lost permanently. We cannot restore access. We will never ask you for your keys or seed phrase — anyone who does is trying to steal from you.

Before you sign or confirm anything, check it yourself: the asset, the network, the size, the direction, the leverage and the destination address.

4. Fees

Trading through the Protocol incurs fees charged by the Protocol itself, including taker and maker fees and funding payments. Those are set by the Protocol and are not paid to us.

Remittix operates as a builder on the Protocol. Orders you place through the Interface may include a builder fee payable to us for providing the Interface. The current builder fee is shown in the Interface before you submit an order. By submitting an order, you agree to that fee being applied.

We may change the builder fee at any time. Changes apply only to orders placed after the change is published in the Interface.

You also pay any blockchain network and bridging fees. All fees are non-refundable. You are responsible for your own taxes — we do not calculate, withhold or report them for you.

5. Risks

Trading perpetual contracts is extremely risky. You can lose everything you put in. Do not trade with money you cannot afford to lose. Leverage magnifies losses as much as gains. If your margin falls below the maintenance level, the Protocol can liquidate your position automatically, without warning, possibly at a much worse price than the mark price shown to you.

Funding payments are exchanged between longs and shorts and can steadily erode a position. Prices, margin and liquidations are based on oracle and mark prices produced by the Protocol and third-party sources, which may be delayed, inaccurate or manipulated.

In volatile or illiquid markets, or during network congestion or Protocol downtime, orders may not execute at all, or may execute far from the price you expected. Stop-loss and take-profit orders do not guarantee any particular execution price. TWAP and other advanced orders may fill partially or not at all.

Some markets track the price of shares, indices, commodities or currencies. These are synthetic derivatives settled in digital assets. You are not buying the underlying asset and get no ownership, dividends, voting rights or any other shareholder rights. We are not affiliated with, endorsed by or sponsored by any issuer, index provider or exchange, and prices may be stale or gap sharply when the underlying market is closed.

You also accept the risks of smart contract bugs and exploits, blockchain failures and forks, wallet and browser compromise, phishing and fake interfaces, interface downtime and display errors, and regulatory changes affecting digital assets or the Protocol.

Everything shown in the Interface — prices, charts, positions, PnL, margin, liquidation prices, funding, open interest, equity — is for convenience only and may be wrong or delayed. The Protocol's on-chain state is what counts.

6. What You Must Not Do

You must not:

  • use the Interface if you are restricted under Section 2, or try to get around any access restriction;
  • use the Interface for money laundering, terrorist financing, sanctions evasion, fraud, tax evasion or anything else unlawful;
  • manipulate the market — including spoofing, layering, wash trading, self-trading, quote stuffing or trading on inside information;
  • exploit any bug, error, vulnerability or unintended behaviour of the Interface or the Protocol;
  • use bots, scrapers or automated access outside documented means, or overload our infrastructure;
  • opy, modify, reverse engineer or create derivative works from the Interface;
  • interfere with the Interface or try to gain unauthorised access to our systems or other users' systems;
  • impersonate anyone or misrepresent your affiliation with anyone.

7. No Advice

Nothing in the Interface is investment, financial, legal, tax or accounting advice, and nothing is a recommendation or an offer to buy or sell anything. Every decision you make is your own, based on your own analysis and at your own risk.

These Terms do not make us your adviser, agent, broker, fiduciary or partner. It is your responsibility to check whether using the Interface is legal where you live and to comply with the laws that apply to you.

8. Intellectual Property

The Interface, its design, text, graphics, logos and software belong to Remittix or our licensors, apart from third-party and open-source components and on-chain data. "Remittix", "Remittix Markets" and our logos are our trade marks and you have no right to use them.

Open-source components remain governed by their own licences. If you send us feedback or suggestions, we may use them freely and without owing you anything.

9. Third-party Services

The Interface links to and integrates third-party services, including the Protocol, wallets, bridges, RPC nodes, price and charting providers and analytics tools. We do not control them and are not responsible for them. Linking to them is not an endorsement, and your use of them is governed by their own terms.

10. Availability, Changes and Termination

The Interface is provided "as available". We may change, restrict, suspend or shut down the Interface, any feature or any market at any time, without notice.

We may block or terminate your access at any time, including where the law requires it or where we believe you are restricted under Section 2 or have breached these Terms.

Losing access to the Interface does not affect your positions or assets on the Protocol — those remain yours and remain reachable directly or through other interfaces. We have no obligation to close or manage any position for you.

11. Disclaimer

The Interface is provided "as is" and "as available", with all faults and without warranty of any kind, to the fullest extent the law allows.

We do not promise that the Interface will be uninterrupted, secure, timely, accurate or error-free, that any data shown is correct or current, that any order will be transmitted, executed or cancelled, that defects will be fixed, or that the Interface is free of harmful components. We make no representation or warranty whatsoever about the Protocol, any smart contract, any blockchain or any digital asset.

Where the law does not allow certain warranties to be excluded, this section applies as far as it legally can.

12. Limitation of Liability

To the fullest extent permitted by law, neither Remittix nor our affiliates, officers, directors, employees, agents or licensors will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, trading losses, lost opportunities, lost assets, lost data or lost goodwill.

Our total liability arising out of or relating to these Terms or the Interface will not exceed one hundred United States dollars (US$100).

We have no liability at all for losses arising from the Protocol or any smart contract, any liquidation, any oracle or funding calculation, any blockchain, any third-party service, or your wallet and keys.

Nothing here excludes liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

13. Indemnity

You agree to cover our losses, including reasonable legal costs, arising from your use of the Interface or the Protocol, your breach of these Terms, your breach of any law or third-party right, any false statement you make about your eligibility under Section 2, or any tax arising from your activity.

14. Governing Law and Disputes

These Terms, and any dispute connected with them, are governed by the laws of the British Virgin Islands, without regard to conflict of law rules.

Before starting any formal proceedings, contact us at support@remittix.io with a written description of the dispute. We will try in good faith to resolve it informally for sixty (60) days.

If it is not resolved, the dispute will be finally settled by binding arbitration administered by the BVI International Arbitration Centre under its rules in force at the time. The seat will be the British Virgin Islands, the language English, and there will be one arbitrator.

You and Remittix may bring claims only individually, and not as part of any class, collective or representative proceeding. The arbitrator may not combine claims from more than one person. To the extent the law allows, both sides waive any right to a jury trial.

Any claim must be brought within one (1) year of the event giving rise to it. Either side may still ask a court for urgent or injunctive relief to protect its intellectual property or confidential information.

15. Changes to These Terms

We may update these Terms at any time by posting a new version in the Interface and changing the "Last updated" date. Changes take effect as soon as they are posted. If you keep using the Interface afterwards, you accept the new version, so please check back from time to time.

16. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Interface. If any part is found invalid, the rest stays in force. Not enforcing a provision does not mean we waive it.

You may not transfer your rights under these Terms without our written consent. We may transfer ours freely, including as part of a merger or sale. We are not liable for delays or failures caused by events beyond our reasonable control, including war, government action, network outages or blockchain failures.

These Terms are written in English. Any translation is for convenience only, and the English version prevails.
